Terms of sale

These general terms and conditions of sale are entered into on the one hand by SAS DREAM with a capital of 110,500 euros (one hundred and ten thousand five hundred euros), whose registered office is located at 6 Bis Rue Blanc Dutrouilh 33000 Bordeaux, registered in the Bordeaux Trade and Companies Register under number 798 908 596, hereinafter referred to as "FIVE", and which manages the www.five-jeans.com website, and on the other hand by any individual or legal entity wishing to make a purchase via the www.five-jeans.com website, hereinafter referred to as "the buyer".

Article 1 Purpose

The purpose of these terms of sale is to define the contractual relationship between FIVE and the buyer and the specific conditions applicable to any purchase made through the www.five-jeans.com website. The purchase of a product through this site implies unreserved acceptance by the buyer of these terms and conditions of sale, which the buyer acknowledges prior to placing an order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site www.five-jeans.com

has no direct link with his/her professional activity and is limited to strictly personal use, and that he/she is fully entitled to undertake to respect the following general conditions.

Five reserves the right to modify the terms and conditions of sale at any time, in order to comply with any new regulation or to improve the website. Thus, the applicable Conditions are those in force at the time of the registration of the order.

Article 2. The products

The items offered for sale are those listed on the www.five-jeans.com website of FIVE, within the limits of available stocks. The company reserves the right to modify the product range at any time. Each product is presented on the site in the form of a brief with its main technical characteristics (length, composition). The photos are as accurate as possible but do not commit the seller. The products presented on the site www.five-jeans.com are intended for all buyers residing in countries that fully authorise the entry of these products.

Article 3. The prices

The prices of the products in the internet catalogue are in euros and include the VAT applicable on the day of the order. Any change in the VAT rate may have an immediate impact on our prices. FIVE reserves the right to change its prices at any time, it being understood, however, that the price shown in the catalogue on the day of the order shall be the only price applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased after the amount of the order. In metropolitan France, for any order over 150 € the delivery costs are free.

Article 4. Order and payment terms

Before placing an order, the buyer must create an account on the website www.five-jeans.com. The account creation section is directly accessible in the side menu. Each time the buyer visits the site, if he wants to order or consult his account (order status, profile, etc.), he must log in with this information. FIVE offers the buyer to order and pay for the products in several steps:

- Secure payment by Paypal or credit card (via the Paypal system): the buyer chooses the products he wants to order in the "basket", modifies them if necessary (quantities, references....), checks the delivery address or communicates another one. Then, the shipping costs are calculated and submitted to the buyer, with the name of the carrier. Then, the buyer chooses the payment method of his choice: "Payment by Paypal". The next step is to check all the information, to read and accept the present general conditions of sale by ticking the corresponding box, and then to invite the buyer to confirm his order by clicking on the "Confirm my order" button. The buyer is then redirected to the PAYPAL secure interface in order to carefully fill in the references of his Paypal account or his personal credit card. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by Paypal account or credit card is irrevocable. In the event of fraudulent use of the card, the buyer can demand the cancellation of the card payment, so that the amounts paid will be credited back or returned. The credit card holder is not liable if it is proven that the disputed payment was made fraudulently, at a distance, without physical use of the card. In order to obtain reimbursement of the fraudulent debit and any bank charges that may have been generated by the transaction, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction,and even 120 days if the contract relating to it so provides. Direct debits shall be reimbursed by the bank within a maximum of one month after receipt of the written objection by the holder. The holder cannot be charged for the return of the amounts.

- Payment by ultra-secure bank card (via the Lemon Way system): the buyer chooses the products he/she wishes to order in the "basket", modifies them if necessary (quantities, references...), checks the delivery address or informs another. Then, the shipping costs are calculated and submitted to the buyer, with the name of the carrier. Then, the buyer chooses the payment method of his choice: "Payment by credit card". In the next step, the buyer is asked to check all the information, to read and accept the present general terms and conditions of sale by ticking the corresponding box, and then to confirm the order by clicking on the "Confirm my order" button. The buyer is then redirected to the secure Lemon Way interface in order to carefully fill in his/her personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by credit card is irrevocable. In the event of credit card fraud, the purchaser may demand the cancellation of the credit card payment, so that the sums paid will be credited back or refunded. The credit card holder is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. In order to obtain reimbursement of the fraudulent debit and any bank charges that may have been generated by the transaction, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, and even 120 days if the contract relating to the transaction so provides. The bank will reimburse the direct debits within a maximum of one month after receiving the written objection from the cardholder. No costs for the return of the amounts can be charged to the holder.

Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement of having full knowledge of them and waiver of the right to invoke one's own terms and conditions of purchase. All the data recorded and confirmed is proof of the transaction. If the buyer has an e-mail address and has provided it on the order form, FIVE shall send the buyer an e-mail confirming that the order has been registered.

Article 5. Retention of title

FIVE shall retain full ownership of the items sold until full payment of the principal, all taxes and fees included.

Article 6. Withdrawal

In accordance with Article L121-20 of the Consumer Code, the buyer has a period of 14 (fourteen) clear days from the delivery of the order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund without penalty except for the cost of return.

Article 7. Delivery

The items ordered are delivered to the address indicated on the order form, which can only be in the agreed geographical area. Orders are made by Chronopost, a delivery service with tracking, delivery without signature. Delivery times are given as an indication only, if the thirty-day period from the order is not met, the sales contract may be cancelled and the buyer reimbursed. FIVE may provide the buyer with an order tracking number by e-mail. The buyer shall be delivered to his home or business address by the postman. In case of absence, the buyer shall receive a notice of passage from the postman, which allows him to claim the ordered products at the nearest post office, during the period indicated in the notice. The risks inherent in transport shall be borne by the buyer from the time the products leave FIVE's premises. The customer is obliged to check the packaging and contents of the order in the presence of the postman or carrier at the time of delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Guarantee

All products sold by FIVE are covered by the legal warranty provided for in Articles 1641 et seq. of the French Civil Code. In the event of non-conformity of the product sold, it may be returned to FIVE and exchanged or refunded.All claims, requests for exchange or refund must be made by post to the following address SAS DREAM 8 rue de Soyouz 31240 L'union, within thirty days of delivery.


Article 9. Liability

The company FIVE, in the course of online sales, is only bound by an obligation of means. It shall not be held liable for any damage resulting from the use of the Internet such as loss of data, intrusion, virus, breakdown of service, or any other involuntary problem.

Article 10. Intellectual property

All elements of the www.five-jeans.com website are the exclusive intellectual property of FIVE. No one is authorised to reproduce, exploit or use for any purpose whatsoever, even partially, elements of the site, whether in the form of photos, logos, visuals or text.

Article 11. Personal data

FIVE undertakes to preserve the confidentiality of information provided by the buyer, which he may be required to transmit for the use of certain services. All information concerning him/her is subject to the provisions of the French Data Protection Act No. 78-17 of 6 January 1978 and Act No. 2018-493 of 20 June 2018. Thus, the Internet user has the right to access, modify and delete information concerning him/her. Article 12. Settlement of disputes

These distance selling conditions are subject to French law. For any dispute or litigation, the competent court will be that of Toulouse.
